Curator v. Cantonal Disability Insurance Office (Moot Appeal)
Synthèse Legislator
Généré par l'IAAn individual, represented by their curator, appealed a decision from the Cantonal Disability Insurance Office that refused to rule on their request for benefits. During the appeal process, the Office subsequently annulled its initial refusal decision and remanded the case for further investigation and a new ruling. The Cantonal Social Insurance Tribunal determined that, pursuant to the general law on social insurance, the agency retained the right to reconsider its decision until notifying the Tribunal of its final opinion, meaning the appeal against the initial decision became moot, leading the court to strike the case from its roll.
