Appeal Moot Due to Administrative Reconsideration Annulment
Synthèse Legislator
Généré par l'IAAn insured individual appealed a five-day suspension of unemployment benefits imposed by the employment office for insufficient job search efforts in the preceding month, a decision that was upheld upon initial opposition. However, before the court ruled, the cantonal employment office re-examined the file and issued a decision of reconsideration, annulling both the initial suspension and the decision on opposition. Consequently, the Social Insurance Cantonal Court determined that, pursuant to the relevant law allowing reconsideration prior to sending its brief to the Tribunal, the appeal had become moot, leading the court to take note of the annulment and strike the case from the roll.
