Insured Withdraws Appeal of Partial Disability Allowance
Synthèse Legislator
Généré par l'IAAn insured individual appealed a decision from the disability insurance office that granted a partial disability allowance beginning in 2006 and a lower allowance starting in 2011, while denying supplements for intensive care. The reviewing court noted that the appellant, through their legal representative, formally withdrew the appeal. Consequently, applying the relevant administrative procedure law which stipulates that the withdrawal of an appeal terminates the proceedings, the court accepted the withdrawal and struck the case from the record.

Généré par l'IAThis article, cited in the reasoning regarding the withdrawal of the appeal, forms the legal basis for the procedural outcome mentioned in the dispositive (taking note of the withdrawal, which terminates the procedure).
Cited implicitly via the decision not to charge any fees, which corresponds to the application of cost provisions (although LTF is not explicitly cited, the reference to 'aucun émolument n’est perçu' implies the application of cost rules, which in federal proceedings often refers to the LTF).
