Moot Appeal Due to Withdrawal of Contested Decision
Synthèse Legislator
Généré par l'IAAn individual appealed a decision from the cantonal disability insurance office (OCAI) that had denied them a disability pension. However, before the appellate court ruled on the appeal, the OCAI issued a subsequent decision on May 13th, which explicitly annulled its prior decision of March 16th and ordered the resumption of the instruction (investigation) into the claim. The court found that, pursuant to the law allowing the insurer to reconsider a decision against which an appeal has been filed, the situation presented constituted a withdrawal of the initial contested decision, rendering the appeal moot, while ordering the OCAI to pay the appellant's costs and disbursements.
