Claim Withdrawal and Mootness in Payment Action Against Insurer
Synthèse Legislator
Généré par l'IAA claimant initiated a payment action against an insurer, but subsequently withdrew the claim because the defendant agreed to settle the disputed amounts based on a transactional agreement reached with the State concerning prior years. The arbitral tribunal accepted the withdrawal, deeming the request unopposed and noting that the judicial procedure was not free, thus ordering the claimant to bear the CHF 150 judicial costs as per their commitment, ultimately declaring the demand moot and removing the case from the docket.

Généré par l'IAThis provision is cited implicitly in the reasoning as the basis for charging judicial costs, which is confirmed in the dispositive.
This provision is usually cited in Swiss federal decisions for procedural consequences, but since the decision does not explicitly cite any article in the dispositive regarding the declaration of the case becoming moot (1), and only cites a cantonal law for costs in the reasoning, no procedural provision applied in the dispositive can be identified from the provided text other than the cost provision.

2. Met un émolument judiciaire de 150 fr. à la charge de la demanderesse.
