Insurance Payment Claim Withdrawal and Judicial Costs Allocation
Synthèse Legislator
Généré par l'IAA party that had initiated a payment claim against an insurance company subsequently withdrew that claim because the defendant agreed to settle the disputed amounts in accordance with a prior transactional agreement with the State, leading the arbitral tribunal to declare the demand moot and strike the case from the docket. The court reasoned that the withdrawal was permissible and, since the arbitration proceedings were not free, it ordered the withdrawing party to bear the judicial costs, which were fixed at 150 francs, as per their commitment in the withdrawal request.

2. Met un émolument judiciaire de 150 fr. à la charge de la demanderesse.
