Social Insurance Appeal Mooted by Administrative Reconsideration and Cost Award
Synthèse Legislator
Généré par l'IAAn individual appealed a social insurance authority's rejection of their opposition to a prior decision regarding a claim, but the appeal was rendered moot when the authority, acting under the law allowing reconsideration of a decision pending appeal, subsequently annulled its challenged decision and initiated a multidisciplinary expert assessment to re-examine the matter. The Court consequently declared the appeal without object, as the administrative act being contested was withdrawn, but ordered the authority to pay the appellant's legal costs because the recourse was initially properly lodged before the administrative reconsideration occurred.

Applied as the transitional provision governing the court's decision-making process.
This article is implicitly cited as the basis for awarding costs to the appellant, which is a standard cost rule in federal social security cases, even if the text references the cantonal law contextually via the federal procedure (though the explicit citation is missing, standard practice for awarding costs in such dispositive sections often relies on the procedural rules that govern cost allocation, which in this context often defaults to provisions similar to Art. 66 LTF or equivalent Cantonal rules, but based strictly on the output requirement, only explicitly cited articles are used. However, looking strictly at the dispositive, the decision imposes costs without explicitly citing a cost article like Art. 66 LTF. The text only states: 'Condamne l'OCAI à payer au recourant la somme de fr. 500.- à titre de participation à ses frais et dépens.' Since no explicit cost article like Art. 66 LTF is cited *in the dispositive*, I must only list provisions that are actually cited. The only citation besides Art. 53 LPGA and Art. 162 LOJ is the procedural context regarding the awarding of costs, but no specific article for costs is written in the operative part. I will check again: The text mentions: 'Que le recourant, représenté par un avocat, a droit à une indemnité à titre de dépens;'. Then the operative part orders the payment of costs. If no specific cost article (like Art. 66 LTF or its cantonal equivalent) is explicitly written out in the final orders, it should not be included based on the strict rule provided. Since only Art. 53 al. 3 LPGA and Art. 162 LOJ are explicitly cited in the operative section, only those two will be included.
