Synthèse Legislator

Généré par l'IA

The appellant filed an appeal against a decision by the cantonal unemployment insurance fund, but because the appeal was lodged directly against the initial decision rather than the subsequent decision on opposition, as required by social insurance law, the court declared the appeal inadmissible. The court reasoned that under the relevant law, decisions must first be challenged via an opposition, and only the decision on that opposition is subject to appeal; however, applying an analogous rule for timely submissions to an incompetent authority, the court transmitted the case back to the appellee insurance fund to be treated as a timely filed opposition.
