Claimant Withdraws Payment Claim; Claimant Ordered to Pay Fees
Synthèse Legislator
Généré par l'IAThe claimant initiated a payment claim against the defendant insurer, but subsequently withdrew the action because the defendant agreed to settle the disputed amounts based on a settlement agreement reached with the State, with the withdrawal specifying that court costs would be borne by the claimant. The Arbitral Tribunal found no objection to the requested striking of the case from the roll and, consistent with the claimant's undertaking and relevant law regarding non-free judicial procedures, ruled the claim moot, struck the matter from the roll, and ordered the claimant to pay CHF 150 in judicial fees.
Regeste Legislator
Généré par l'IAart. 46 de la loi cantonale d'application de la LAMal du 29 mai 1997; Claimant Withdraws Payment Claim; Claimant Ordered to Pay Fees: The Arbitral Tribunal found no objection to the requested striking of the case from the roll and, consistent with the claimant's undertaking and relevant law regarding non-free judicial procedures, ruled the claim moot, struck the matter from the roll, and ordered the claimant to pay CHF 150 in judicial fees.

ARRET
2. Met un émolument judiciaire de 150 fr. à la charge de la demanderesse.
