Synthèse Legislator

Généré par l'IA

An appeal was brought by a former company administrator challenging a decision by the Cantonal Family Allowance Service (SCAF) to hold him personally liable for unpaid family allowance contributions following the company's bankruptcy. The court reasoned that under relevant law, the basis for calculating family allowance contributions is the same as that for calculating paritary contributions under the Old Age and Survivors' Insurance (AVS) law, and that the liability of corporate officers for both types of contributions is governed identically, specifically referencing the principle of analogous application of employer liability provisions. Consequently, since a related judgment regarding AVS contributions had already been rendered rejecting the appeal, this court also rejected the appeal concerning family allowance contributions, upholding the SCAF's decision.

RÉPUBLIQUE ET CANTON DE GENÈVE

POUVOIR JUDICIAIRE

Contre

SERVICE CANTONAL D’ALLOCATIONS FAMILIALES (SCAF), 54 route de Chêne, case postale, 1211 GENEVE 6 · défendeur

ATTENDU EN FAIT

Que, par jugement du 29 septembre 2003, le Tribunal de première instance a prononcé la faillite de la société P__________ SàRL ;

Que Monsieur B___________ en était l’administrateur unique ;

Que par décision du 28 octobre 2004, le SERVICE CANTONAL D’ALLOCATIONS FAMILIALES (ci-après le SCAF) lui a réclamé le paiement des contributions aux allocations familiales restées impayées par la société ;

Que par décision sur opposition du 13 mai 2005, le SCAF a confirmé cette décision ;

Que l’intéressé a interjeté recours le 30 mai 2005 contre ladite décision ;

Qu’il a également recouru contre la décision sur opposition concernant les cotisations AVS/AI/APG/AC à lui notifiée par la CAISSE CANTONALE GENEVOISE DE COMPENSATION ;

Que par jugement incident du 15 septembre 2005, le Tribunal de céans a suspendu l’instance jusqu’à droit connu dans la procédure engagée en matière d'AVS (n°A/1897/2005) ;

Qu'en matière AVS-AI-APG-AC, par jugement du 16 février 2006, le Tribunal a rejeté le recours ;

Que ledit jugement est désormais entré en force ;

CONSIDERANT EN DROIT

Qu’aux termes de l’art. 27 al. 1 LAF, le revenu soumis à contributions du point de vue des allocations familiales est le même que celui qui sert de base au calcul des cotisations paritaires selon la loi fédérale sur l’assurance vieillesse et survivants ;

Que selon l’art. 30 al. 3 LAF, l’employeur qui, intentionnellement ou par négligence grave, viole des prescriptions et cause ainsi un dommage à la caisse d’allocations familiales, est tenu de le réparer ;

Que cette disposition prévoit par ailleurs l’application par analogie de l’art. 52 LAVS qui règle la responsabilité des employeurs pour les dommages causés aux caisses de compensation ;

Que la responsabilité des organes de la société pour les cotisations paritaires AVS-AI-APG-AC et pour les contributions d’allocations familiales est dès lors réglée de manière identique ;

Qu’il y a donc lieu de trancher le litige en matière d’allocations familiales dans le même sens qu’en matière de cotisations AVS ;

Que le sort de la présente cause étant lié à celui du litige en matière d’AVS, il convient de se référer au jugement rendu par le Tribunal de céans en date du 16 février 2006 (ATAS 160/2006);

Qu’en conséquence il convient de rejeter le recours interjeté contre la décision rendue par le SCAF en date du 13 mai 2005 en matière d’allocations familiales ;

PAR CES MOTIFS,

LE TRIBUNAL CANTONAL DES ASSURANCES SOCIALES :

Statuant

(conformément à la disposition transitoire de l’art. 162 LOJ)

Préalablement :

Reprend l'instance.

Au fond :

Rejette le recours.
