Social Insurance Costs and Fees Following Federal Tribunal Remand
Synthèse Legislator
Généré par l'IAFollowing a previous decision on the merits regarding an invalidity pension claim, which was partially annulled and remanded by the Federal Tribunal concerning the duration and level of the benefit, the Social Insurance Chamber of the Court of Justice ruled solely on the issue of costs and fees. Since the appeal procedure instituted in 2006 is subject to judicial fees and the appellant ultimately did not prevail on the aspect of the claim that led to the Federal Tribunal's remand (which involved the award of a benefit greater than a half-pension from a specific date), the Court ordered the appellant to pay judicial fees of 200 Swiss Francs.
