Lack of Jurisdiction Due to Unexhausted Administrative Appeal
Synthèse Legislator
Généré par l'IAThe litigant challenged a decision by the cantonal compensation fund demanding payment of a student personal contribution, leading the fund to issue a decision on opposition, which the litigant then appealed to the Cantonal Social Insurance Tribunal. The Tribunal determined that under the relevant law, only decisions made on opposition, or those for which no opposition procedure exists, are subject to appeal, and since the litigant had not yet exhausted the administrative appeal route by challenging the subsequent decision on opposition, the court declared it lacked jurisdiction to rule on the matter at that stage.

En la cause
Madame E__________ · Recourante
Contre
CAISSE CANTONALE GENEVOISE DE COMPENSATION, Route de Chêne 54, Genève · Intimée
Attendu que par décision du 14 octobre 2003, la Caisse cantonale genevoise de compensation (ci-après la Caisse) a réclamé à Madame E__________ le paiement de la cotisation personnelle d’étudiante ;
Que l’intéressée a contesté ladite décision auprès du Tribunal de céans ;
Que la Caisse, informée, a rendu le 20 février 2004 une décision sur opposition ;
Considérant en droit que les décisions peuvent être attaquées dans les 30 jours par voie d’opposition auprès de l’assureur qui les a rendues (art. 52 LPGA) ;
Qu’il appartient dès lors à la Caisse de statuer sur opposition, ce qu’elle a du reste fait le 20 février 2004 ;
Qu’aux termes de l’art. 56 al. 1 LPGA, seules les décisions sur oppositions et celles contre lesquelles la voie d’opposition n’est pas ouverte sont sujettes à recours ;
Que le Tribunal de céans ne saurait à ce stade entrer en matière ;
Que l’intéressée aurait pu recourir contre la décision sur opposition ;
PAR CES MOTIFS,
LE TRIBUNAL CANTONAL DES ASSURANCES SOCIALES
Statuant
conformément à la disposition transitoire de l’article 162 LOJ
Déclare ne pas entrer en matière.
