Appeal Concerning Reduction of Disability Pension Declared Moot Upon Reopening of Case
Synthèse Legislator
Généré par l'IAAn insured person appealed a decision by the cantonal disability insurance office (OCAI) that had reduced their full disability pension, claiming an adapted 100% activity was possible starting May 1, 2007, despite medical reports indicating severe ankylosing spondylitis still prevented any gainful employment. Subsequently, the OCAI issued a new decision on February 12, 2008, revoking the previous one to resume instruction of the case based on the arguments and evidence presented by the insured. Consequently, the Court declared the appeal moot, recorded the OCAI's decision to reopen the file, and ordered the OCAI to pay the appellant CHF 500 for costs and fees.
