Employer Appeal of Initiation Employment Allowance Duration Withdrawn Due to Employee Resignation
Synthèse Legislator
Généré par l'IAThe employer appealed a decision from the Cantonal Employment Office (OCE) that limited an initiation employment allowance (AIT) for a new hire to six months, with the employer subsequently submitting a revised training plan seeking a one-year allowance, which the OCE deemed unsupported by new elements. The court noted that the employer subsequently withdrew the appeal because the employee had resigned, rendering the continuation of the proceedings unnecessary, and therefore decided to acknowledge the withdrawal and strike the case from the role, declaring the procedure free of charge.

Généré par l'IAThis provision is cited immediately before the operative part regarding the costs, although the dispositive itself only orders the procedure to be free.
Although not explicitly cited in the dispositive, the procedure being free (ordre 3) implies no costs were ordered against the parties, which is typically governed by procedural cost rules. However, following the strict rule, only explicitly cited articles are included. Since the dispositive cites only procedural rules related to the withdrawal and costs declaration, and no explicit cost article is in the dispositive, we rely only on the explicit citation.

A/2108/2023 ATAS/172/2024 COUR DE JUSTICE Chambre des assurances sociales
Arrêt du 19 mars 2024 Chambre 15
En la cause
A______ SA · recourante
contre
OFFICE CANTONAL DE L'EMPLOI · intimé
Vu la décision sur opposition du 19 juin 2023 par laquelle l’Office cantonal de l’emploi (ci-après : OCE) a accordé une allocation d’initiation à l’emploi (ci-après : AIT) à A______ SA (ci-après : l’employeuse) en vue de l’engagement de B______, limitée à six mois ;
Vu la lettre que l’employeuse a adressé à la chambre des assurances sociales de la Cour de justice (ci-après : la chambre de céans) le 20 juin 2023 pour lui indiquer qu’elle avait pris en compte des commentaires contenus dans la décision de l’OCE et avait dès lors révisé le plan de formation de l’employée pour justifier une AIT d’un an ;
Vu la réponse de l’OCE selon laquelle l’employeuse n’apportait pas d’éléments nouveaux ;
Attendu que l’employeuse a indiqué, par courrier du 15 mars 2024, vouloir retirer son recours dans la mesure où son employée avait démissionné le 11 septembre 2023 ce qui ne justifiait plus la poursuite de la procédure ;
Qu'il convient d'en prendre acte et de rayer la cause du rôle ;
Vu l'art. 133 al. 3 et 4 let. a de la loi sur l’organisation judiciaire du 26 septembre 2010 (LOJ ‑ E 2 05).
PAR CES MOTIFS,
LA CHAMBRE DES ASSURANCES SOCIALES :
1. Prend acte du retrait du recours.
2. Raye la cause du rôle.
3. Dit que la procédure est gratuite.
