Synthèse Legislator

Généré par l'IA

An association filed a payment claim against a health insurance mutual, but subsequently requested the withdrawal and striking of the case from the roll because the defendant agreed to settle the disputed amounts according to a transactional agreement previously concluded with the Canton, with the costs being compensated between the parties, except for the court fees which the claimant agreed to bear. The Arbitral Tribunal found no objection to the requested withdrawal, noted that the arbitration procedure was not free, and upheld the claimant's undertaking to pay the judicial fees, resulting in the declaration that the demand was moot, the striking of the case from the roll, and an order for the claimant to bear the 150 franc judicial fee.

ARRET

2. Met un émolument judiciaire de 150 fr. à la charge de la demanderesse.
