Disability Insurance Appeal and Legal Aid Fee Waiver
Synthèse Legislator
Généré par l'IAThe case involves a challenge by an insured party against a decision from the cantonal disability insurance office, with the matter returning to the Social Insurance Chamber of the Court of Justice following a Federal Tribunal ruling that annulled a prior decision and remanded the case specifically for a ruling on costs. The court determined that although the appellant, having lost the appeal, would ordinarily be liable for a fee, it decided to waive the collection of any fee because the appellant benefited from legal aid.

Généré par l'IAThis provision is cited in the reasoning section concerning the obligation to pay costs, although it is not explicitly cited in the final order regarding the waiver of costs.
The court mentions the assistance juridique (legal aid), which corresponds to Art. 64 LTF, in the reasoning, but the operative part refers to the waiver of the fee (émolument) because the party benefits from legal aid, which is the subject of order 1, although the explicit procedural rule (Art. 64 LTF or corresponding cantonal rule for costs waiver based on legal aid) is not explicitly repeated in the final order.
Although the final order only states 'Renonce à percevoir un émolument', the preceding text justifies this by referencing the benefit of legal aid, which typically invokes Art. 64 LTF regarding costs and legal aid for the losing party, and the text mentions the procedure related to legal aid.
