Social Insurance Appeal Regarding Psychiatric Evaluation and Costs
Synthèse Legislator
Généré par l'IAThe case concerns a dispute where an insured party appealed a decision by the social insurance office to assign a psychiatric evaluation to a specific doctor. The reviewing court initially allowed the appeal and awarded costs to the appellant, but the Federal Tribunal subsequently annulled that decision, remitting the matter solely for a ruling on costs before the cantonal chamber. Applying relevant procedural law, the court reasoned that since the appellant ultimately did not prevail in the overall matter (following the Federal Tribunal's ruling), no costs or indemnity would be awarded to the appellant at the cantonal level.

Although not explicitly mentioned in the text provided, if this were a Federal Tribunal decision, the cost disposition (Order 1) would typically reference the procedural rule governing costs (like Art. 66 LTF) if applicable, but based strictly on the provided text, the relevant cost principles cited are cantonal (Art. 61 LPGA and Art. 89 LPA).
