Insured Party v. Social Insurance Office (Moot Appeal and Annulment)
Synthèse Legislator
Généré par l'IAAn insured party appealed a decision by the social insurance office that refused to rule on their claim for benefits. The office subsequently issued a new decision annulling its initial ruling and remitting the case for further investigation and a new decision, which is permissible under federal social insurance law when done prior to the insurer sending its response to the reviewing authority. Consequently, the Cantonal Social Insurance Tribunal declared the appeal moot, noted the annulment of the initial decision, and ordered the insurance office to pay the appellant a contribution toward their legal costs.
