Withdrawal of Appeal as Final Decision Without Costs Imposed
Synthèse Legislator
Généré par l'IAAn appellant filed an appeal against a lower court judgment but subsequently withdrew the appeal before any substantive appellate proceedings occurred. The court ruled that the withdrawal of the appeal has the effect of a final decision, leading to the case being removed from the role, and determined that since no investigative acts were performed and the opposing party was not asked to respond, neither court fees for the appeal nor an award of costs to the opposing party would be imposed.
