Withdrawal of Appeal Without Cost Collection
Synthèse Legislator
Généré par l'IAThe appellate court addressed a civil matter where one party filed an appeal against a lower court's order but subsequently withdrew that appeal after failing to pay the required advance on costs. The court reasoned that a withdrawal of action has the effect of a final decision under the Code of Civil Procedure, requiring the authority seized to strike the case from the roll, and since no investigative acts had been performed in the appeal proceedings, the court waived the collection of any judicial costs for the appeal.
