Attorney's Appeal of Legal Aid Compensation Deemed Moot by Annulment of Underlying Judgment
Legislator-Zusammenfassung
KI-generiertThe case involved a dispute between an individual and the Office of Disability Insurance from a specific canton regarding the allocation of judicial assistance and the corresponding attorney's fees. Following a ruling by the administrative tribunal, which granted judicial assistance and set the attorney's fee at a specific amount, the attorney sought a higher fee through a complaint. However, after the federal court annulled the previous judgment and sent the case back for reconsideration, the attorney's request for a higher fee became moot. Consequently, the federal court determined that the appeal was no longer relevant and removed the case from its agenda without imposing court fees.

KI-generiertThe case was struck off the roll because the appeal became without object, which corresponds to procedural dispositions for handling such cases.
The Tribunal federal des assurances ruled that no court fees shall be collected, which falls under the provisions governing court costs.
This article implies the necessity of ruling on costs when a case is declared without object, although it is not explicitly cited in the final orders provided, Article 70 LTF generally pertains to the final disposition and related aspects in the context of the final decision structure outlined by the Tribunal Fédéral. Given the context (ruling on costs), and assuming standard application where costs follow the final disposition, and since no other explicit article is cited for the core ruling besides the procedural one for costs, this step is inferred as the general basis for the disposition structure.

Instance précédente
Tribunal administratif du canton de Fribourg, Cour des assurances sociales, Givisiez
(Jugement du 18 juin 2003)
Vu le jugement rendu le 18 juin 2003 par le Tribunal administratif du canton de Fribourg dans le litige opposant M.________ à l'Office AI du canton de Fribourg;
vu le chiffre 3 du dispositif de ce jugement aux termes duquel M.________ a été mis au bénéfice de l'assistance judiciaire et l'indemnité allouée à l'avocat B.________ défenseur désigné d'office fixée à 645 fr. 60;
vu l'écriture de «réclamation» de l'avocat B.________ au Tribunal administratif dans laquelle il concluait à l'octroi d'une indemnité de 3'639 fr.;
vu la transmission de cette écriture au Tribunal fédéral des assurances comme objet de sa compétence;
vu l'arrêt rendu ce jour par la Cour de céans laquelle, statuant sur le recours de M.________, a annulé le jugement du Tribunal administratif du 18 juin 2003 et renvoyé la cause à la juridiction cantonale pour statuer sur les dépens;
