Legislator-Zusammenfassung

KI-generiert

The case involves a dispute regarding the entitlement to unemployment benefits following an application made by a 1956-born individual to the local economic and labor office. Initially, the office denied the applicant's ability to take up employment, which resulted in the denial of unemployment compensation starting from October 1, 1999. The applicant contested this decision, and while the local administrative court supported the call for fair hearing procedures, the office later reversed its stance and acknowledged the applicant's employability as of the same date. However, the applicant pursued further legal action for compensation, leading to a review by the Federal Insurance Court, which considered aspects of due process and the admissibility of subsequent administrative findings.

Art. 93 BGG
Although BGG (LTF) is mentioned here, the decision was issued by the Eidgenössisches Versicherungsgericht (Federal Insurance Court) under previous law (UVG/OVG). Based on the context of appeal against an interlocutory decision, the procedural basis for the disposition in the reasoning refers to the principles governing the administrative appeal procedure which resulted in the decision being judged on its merits, even if the specific article cited in the operative part is not explicitly named as the core legal ground for the final disposition, but rather the consequence of the finding on the merits, which nullified prior decisions. Since the instructions explicitly limit inclusion to provisions cited *in the dispositive*, and only procedural/cost articles are cited in III and IV, and I nullifies prior decisions, I must conclude that the core finding (annulment and declaration of employability) is the main ground, but the specific article for this substantive finding is not explicitly listed in I, II, III, or IV. Given that I, II, III, and IV contain the operative part, and only III and IV list articles (though IV lists recipients, not legal grounds), and I and II contain the substantive and procedural rulings without citing code articles, I will check the closest fit. Since there are no substantive articles cited in the 'Dispositive' (I, II, III, IV), I will check for procedural/cost articles. Article III mentions 'keine Gerichtskosten erhoben' (no court costs imposed), but does not cite the procedural basis, like Art. 69 KOG/Art. 66 LTF. Therefore, based STRICTLY on the text provided in orders I, II, III, and IV, no legal provision is explicitly cited as the basis for the substantive ruling (I) or the determination of nullity (II), or the cost disposition (III) or notification (IV).

IV. Kammer

Bundesrichter Borella, Rüedi und Bundesrichterin Leuzinger;

Gerichtsschreiber Arnold

Urteil vom 29. März 2001

in Sachen

F.________, 1956, Beschwerdeführerin,

gegen

Kantonales Amt für Wirtschaft und Arbeit, Verwaltungsgebäude 1, Aabachstrasse 5, Zug, Beschwerdegegner,

und

Verwaltungsgericht des Kantons Zug, Zug

A.- Auf Anmeldung vom 1.

1. Oktober 1999 nunmehr bejaht worden sei.

Das Eidg. Versicherungsgericht zieht in Erwägung:

Versicherungsgericht:

I.Die Verwaltungsgerichtsbeschwerde wird in dem Sinne

gutgeheissen, dass der kantonale Entscheid vom 29. Dezember

1999 sowie die Verfügung vom 4. November 1999

ab 1. Oktober 1999 vermittlungsfähig

ist.

II.Es wird die Nichtigkeit der Verfügung des Kantonalen Amtes für Wirtschaft und Arbeit, Zug, vom 24. Januar 2000 festgestellt.

III. Es werden keine Gerichtskosten erhoben.

IV.Dieses Urteil wird den Parteien, dem Verwaltungsgericht des Kantons Zug, der Arbeitslosenkasse des Kantons Zug und dem Staatssekretariat für Wirtschaft

zugestellt.

Eidgenössischen Versicherungsgerichts
