Divorce Indemnity Under Art. 152 CC and Consideration of Future Earning Capacity Reduction In a divorce case, the court addressed the quantum of the indemnity under Art. 152 Swiss Civil Code (CC) for the blameless spouse facing great indigence, where both parties contested the amount. The appellate court denied the husband's objection to the judicial consideration of the wife's future reduction in earning capacity, reasoning that while a maintenance award cannot be increased later except through the conditions of Art. 153 para. 2 CC, the court may, at the time of divorce, anticipate a likely future reduction in the wife's earning ability and fix an appropriate higher maintenance amount upfront to account for this probable event. This allows the court to determine a present indemnity that realistically addresses the spouse's long-term financial needs, even before the deterioration of earning capacity fully materializes.

BGE 89 II 1 S. 1
