Patent Law: State of the Art for Assessing Technical Progress and Inventive Step Excludes Undisclosed or Forgotten Prior Art

Legislator-Zusammenfassung

KI-generiert

The court (the First Civil Chamber) rendered a decision on the basis of Swiss patent law, clarifying the standard for evaluating the state of the art regarding novelty, technical progress, and inventive step. The court held that for assessing technical progress and inventive step, the state of the art must be judged according to the actual knowledge of persons skilled in the art, meaning a prior publication or realization is considered only if it genuinely influenced technical development; an undisclosed or completely forgotten prior art cannot be taken into account for that assessment. In contrast, the court noted that for novelty, the law expressly introduces a fictional state of the art, allowing an earlier realization or publication to defeat novelty even if it was unknown or forgotten. No final operative outcome regarding who prevailed is stated, as the excerpt focuses solely on the legal reasoning applied to the patent dispute.

7 rem. 6, p. 342; TROLLER, Immaterialgüterrecht, I, p. 202 et suiv.).
