Berufung.
Legislator-Zusammenfassung
KI-generiertInadmissibility of Late Reply Due to Submission to Wrong Court A party failed to submit its reply to an appeal in civil matters (recours en réforme) to the Federal Supreme Court within the mandatory twenty-day deadline, mistakenly sending it to the Cantonal Court instead. While the Cantonal Court forwarded the reply to the Federal Supreme Court, it did so only one day after the legal deadline had expired. The Federal Supreme Court strictly held that for the deadline to be met, the response must be received by the Federal Supreme Court—or posted at a Swiss post office addressed to it—no later than the final day, and submitting it to a wrong authority, even within the deadline, is insufficient; consequently, the court ruled the delayed reply inadmissible and noted that the non-validly participating party would not be entitled to costs if the appeal was dismissed.

BGE 86 II 286 S. 286
32, rem. 6 i. f.).
