Inadmissibility of Public Law Appeal Lacking Specificity on Constitutional Violation The case concerns a public law appeal against a cantonal court decision, alleging a violation of constitutional rights (Art. 4 BV, prohibiting arbitrary actions and denial of justice). The appellant sought the annulment of a judgment by the Court of Justice of the Canton of Geneva. The Federal Tribunal declared the appeal inadmissible because, according to Art. 90 lit. b OJ, an appeal must succinctly specify the constitutional rights violated and precisely explain the nature of the violation. The court reasoned that merely invoking the prohibition of arbitrary action (Art. 4 Cst.) and criticizing the decision as if the Federal Tribunal were an appellate court is insufficient; the appellant must demonstrate, with specific arguments, that the challenged decision is based on manifestly unsustainable or arbitrary interpretation of the law or assessment of evidence, and must provide these arguments in the appeal act itself, without simply referring to submissions made during the cantonal proceedings. The appellant failed to meet these requirements, merely opposing the cantonal court's view without demonstrating its arbitrariness, and therefore the court found the submission inadmissible without reviewing the merits.

BGE 86 I 40 S. 40
