Mandatory License Revocation and Severe Traffic Offenses under Swiss Law
Legislator-Zusammenfassung
KI-generiertMandatory License Revocation and Severe Traffic Offenses under Swiss Law The case clarifies the relationship between the grounds for mandatory license revocation and severe traffic offenses under Swiss law. The core situation concerns the statutory provisions for driver's license withdrawal: Article 16 para. 3 lit. a of the Road Traffic Act (RTA) mandates revocation if a driver seriously endangers traffic safety, while Article 90 no. 2 RTA defines a severe traffic offense punishable by law as grossly violating traffic rules, thereby causing or risking a serious danger to the safety of others. The court reasoned that, following the implementing provision of Article 32 para. 2 of the Ordinance on the Admission of Persons to Road Traffic (which uses the same precise wording as Article 90 no. 2 RTA to define serious endangerment), the previously noted "parallelism" between the requirement for mandatory license revocation (Art. 16 para. 3 lit. a RTA) and the definition of a severe traffic offense (Art. 90 no. 2 RTA) is now an absolute identity; thus, anyone who grossly violates traffic rules, causing or risking serious danger to the safety of others, both commits a severe traffic offense and seriously endangers traffic safety, leading to mandatory license revocation.

Dai considerandi:
Ciò è il caso, conformemente all'art. 32 cpv.
16 cpv. 3 lett. a LCS e all'art. 90 n. 2 LCS.
