Contractor's Assignment of Work Remuneration Claim Upheld Against Client Objection A contractor ceded a claim for the fixed-sum remuneration of the work contract to a bank without the client's consent, leading the client to oppose the assignment, arguing that the nature of the legal relationship or the potential increased risk of having to pay subcontractors (to avoid legal hypothecs) would preclude the assignment. The court held that, under Article 164(1) of the Swiss Code of Obligations, the claim for work remuneration is not inherently tied to the contractor's person, and its assignment, when limited to a specific sum, does not fundamentally change the obligation's nature or content, nor does it typically prejudice the debtor; specifically, the risk of double payment due to subcontractors' legal hypothecs is a pre-existing risk of the work contract and is not aggravated by the assignment. Consequently, the assignment of the work remuneration claim was valid without the client's agreement or reserves.

BGE 109 II 445 S. 445

Considerando in diritto:

164 n. 26; BECKER, art. 164 n. 21; GAUCH/SCHLUEP/TERCIER, Partie générale du droit des obligations, II, n. 2172; VON TUHR/ESCHER, Allg. Teil des schweizerischen OR, II, pag. 344; BUCHER, Schweizerisches OR, Allg. Teil, pag.
