Purchaser's Good Faith Protection Against Unregistered Servitude Despite Visible Path A third-party purchaser acquired a plot of land that was sold *guaranteed free from servitudes*, relying on the land register which failed to record an existing right of way servitude due to a registration office error during a prior lot split. Although the servitude beneficiary argued that the physical situation (the path was the only access to the neighbor's garage) should have raised doubts for the buyer about the register's completeness, the Federal Supreme Court found that the buyer's good faith was protected under Article 973 CC (negative effect of the land register). The court reasoned that since the land register showed the benefiting servitude was still incorrectly tied to the original, much larger parcel, discovering the error would have required highly detailed inquiries—specifically, consulting supporting documentation and cadastral plans—which extend beyond what is required of a good-faith acquirer. Mandating such extensive investigation would undermine the principle of public reliance and legal certainty provided by the land register.

Sachverhalt ab Seite 102

BGE 109 II 102 S. 102
