Convicted Person's Right to be Heard During Revision Evidence Taking The Swiss Federal Supreme Court determined that the European Convention on Human Rights (ECHR) does not govern the procedure for a review of a criminal verdict (revision) under Swiss law, thus rejecting a claimed violation of Article 6 ECHR for the absence of the convicted person during the questioning of witnesses. However, the Court found that applying Article 233 para. 3 of the Ticino Code of Criminal Procedure, which prohibited an incarcerated convicted person from personally appearing before the Cantonal Cassation and Revision Court during the revision procedure—while witnesses were being questioned and evaluated—violated the constitutional right to be heard (Article 4 of the Federal Constitution). The Court reasoned that when the revision court admits and freely evaluates evidence relevant to the merits of the request, the petitioner must be permitted to personally attend the taking of evidence, equating this right to the general right of a party to be heard in a judicial proceeding, even if the strict rights of defense applicable to an accused are not at play in the revision stage.

Nondimeno la giurisprudenza relativa all'art.
