Legislator-Zusammenfassung

KI-generiert

Defamation and Abuse of Official Function for Private Gain The court considered when an allegation that a member of a collegial body prioritizes private interests over public duty in official matters constitutes defamation under Article 173 et seq. of the Swiss Penal Code. The court reasoned that merely suggesting a consideration of private interests is not inherently defamatory, especially since public and private interests often need to be mutually weighed; the statement becomes injurious only if it implies that public duties were negligently disregarded, decisions were based on non-objective grounds, or the consideration of private interests was concealed. However, the court established that the allegation of abusing an official position to enforce private interests fundamentally and immediately harms a person's reputation; furthermore, while changing a stance on a public project due to a conflict with private interests is not dishonorable (since recusals exist), it is dishonorable and potentially criminal to conceal the conflict and actively use the official function to advance private interests over public ones.

103 IV 161

47. Auszug aus dem Urteil des Kassationshofes vom 1. März 1977 i.S. F. gegen R.

Regeste

Art. 173 ff. StGB. Ehrverletzung.
