Appeal Dismissed for Procedural Non-Compliance in Health Insurance Case The Swiss Federal Supreme Court dismissed an appeal concerning a matter of compulsory health insurance as inadmissible because the appellant failed to submit a proper statement of appeal. The appellant only provided the Federal Court with the cantonal judgment (missing a crucial page detailing the dispositive orders) and various unrelated documents, omitting any conclusions, arguments, specific grounds for complaint, or explanations regarding how the contested decision violated the law, thereby failing to meet the basic procedural requirements of Article 42(1) and (2) of the Federal Supreme Court Act. Given the procedural deficiency, the Court rejected the appeal under the simplified procedure according to Article 108(1) of the Federal Supreme Court Act, while waiving judicial costs due to the specific circumstances of the case.

Sentenza del 20 dicembre 2024

III Corte di diritto pubblico

Composizione

Giudice federale Parrino, Presidente,

Cancelliera Cometta Rizzi.

Partecipanti al procedimento

A.________,

ricorrente,

contro

Atupri Assicurazione della salute,

Zieglerstrasse 29, 3001 Berna,

opponente.

Oggetto

art. 95 e 96 LTF

;

DTF 142 I 99

consid. 1.7.1) o conterrebbe accertamenti manifestamente inesatti (

art. 97 cpv. 1 LTF

;

DTF 147 V 35

consid. 4.2),

art. 108 cpv. 1 lett. a e b LTF
