In this case, an individual challenged a previous ruling issued by a cantonal social security court regarding a health insurance dispute. The cantonal court had initially requested a payment in advance for court fees and later rejected the individual's appeal based on the grounds of a lack of merit, stating that the request for legal aid was moot since the court had waived the costs associated with the case. The individual subsequently filed a federal appeal, asserting that their right to a fair hearing had been violated due to the handling of their request for legal aid. However, the federal court noted that since the individual ultimately received the relief they sought (exemption from fees), their appeal lacked a legitimate interest, leading to the conclusion that the appeal was inadmissible.

This article was cited in relation to the foreseeable failure of the appeal, which would normally command the rejection of the request for legal aid, although the request ultimately became moot.
Art. 108 al. 1 let. a et b LTF
The appeal was declared inadmissible based on this procedural rule, which allows for simplified handling of non-meritorious cases.
Art. 66 al. 1 LTF
This article, concerning court costs, is implicitly referenced by the second order stating that no judicial costs shall be levied ('Il n'est pas perçu de frais judiciaires'). However, since the text explicitly states 'Il n'est pas perçu de frais judiciaires' without citing Art. 66 LTF in the orders, and Art. 64 LTF was cited regarding the aid request, I stick strictly to explicitly cited provisions in the orders. Since no cost provision is *explicitly* cited in orders 1, 2, or 3, I will exclude implicit references.
Art. 93 LTF
Although cited in the body of the reasoning (implicitly via Art. 89 al. 1 let. c LTF leading to inadmissibility), the specific final order points 1-3 do not explicitly mention Art. 93 LTF. *Correction*: Reviewing the orders again, Art. 93 LTF is not explicitly in the operative part (1., 2., 3.). The inadmissibility ruling is grounded on the general conditions linked in the reasoning, leading to the application of Art. 108 LTF in the operative part.

Arrêt du 24 septembre 2012

IIe Cour de droit social

Composition

M. le Juge fédéral U. Meyer, Président.

Greffier: M. Berthoud.

Participants à la procédure

P.________,

recourant,

contre

INTRAS Assurance-maladie SA, Tribschenstrasse 21, 6002 Lucerne,

intimée.

Objet

Assurance-maladie,

64 al. 1 LTF ; ATF 129 I 129 consid. 2.3.1 p. 135, 128 I 225 consid.
