Legislator-Zusammenfassung

KI-generiert

The case involves a dispute between an individual and the Office of Disability Insurance for insured persons residing abroad, presented before the Federal Administrative Court. The individual was instructed by the court to pay a fee of 12 francs to complete the advance payment required for a total of 400 francs. The individual later informed the court that the amount had been paid, but the court determined that their subsequent letter did not constitute an appeal against the earlier decision, thus rendering the appeal invalid and untimely.

Art. 108 al. 1 let. a LTF

Used to justify the decision not to enter into the substance of the filing because it was manifestly inadmissible as an appeal.

Art. 93 BGG

Although Art. 93 LTF is mentioned in the context of inadmissibility in the reasoning, the dispositive explicitly states 'Il n'est pas entré en matière sur l'écriture' (No entry in the file), which corresponds to the procedure for definitively stopping the handling of the case, often linked to Art. 93 LTF when questioning the nature of the filing, however, I must adhere strictly to the dispositive. The dispositive states 'Il n'est pas entré en matière', which is often justified by Art. 93 LTF (or equivalent procedural grounds not explicitly cited in relation to the non-entry itself but rather the inadmissibility discussed in the reasoning). Since the reasoning mentions Art. 108 al. 1 let. a LTF regarding inadmissibility, and the dispositive is simply 'Il n'est pas entré en matière', I rely solely on the explicitly cited provision in the reasoning that justifies inadmissibility/rejection, which is Art. 108 al. 1 let. a LTF. The instruction asks for provisions *actually used in the final orders*. Since Art. 108 al. 1 let. a LTF was used to characterize the lack of an appeal, and the outcome is 'Il n'est pas entré en matière', this is the operative procedural rule cited on the inadmissibility that stops the case.

Objet

Assurance-invalidité,

Décision incidente du Tribunal administratif fédéral, 3ème Cour, du 16 novembre 2007.

Considérant:

qu'un litige oppose G.________ à l'Office de l'assurance-invalidité pour les assurés résidant à l'étranger devant le Tribunal administratif fédéral;

que par décision incidente du 16 novembre 2007, le Tribunal administratif fédéral a invité G.________ à lui verser la somme de 12 fr. net, afin que le montant total de l'avance de frais de 400 fr. net (fixé par décision incidente du 24 octobre 2007) puisse être enregistré sur le compte du Tribunal (ledit compte avait été crédité de 388 fr.);

que par lettre du 5 décembre 2007, postée le 20 décembre 2007, G.________ a informé le Tribunal administratif fédéral qu'il avait versé le montant demandé de 12 fr. en date du 5 décembre 2007;

que le 10 janvier 2008, la chancellerie du Tribunal administratif fédéral a transmis la lettre du 20 décembre 2007 au Tribunal fédéral, en exposant qu'il ne lui appartenait pas de décider si elle constituait ou non un « recours de droit administratif »;

que l'écriture postée le 20 décembre 2007 constitue une simple communication à l'attention du Tribunal administratif fédéral, dans laquelle son auteur informe cette autorité qu'il a versé la somme de 12 fr.;
