Disability insurance; appeal inadmissible for failure to pay advance on costs despite extended deadline.
Legislator-Zusammenfassung
KI-generiertThe Swiss Federal Supreme Court declared the insured’s appeal inadmissible, thereby leaving the Cantonal Insurance Court’s decision of 14 December 2015 in force. The appeal concerned a disability insurance (invalidity) matter, challenging the lower court’s ruling against the insured. The Court dismissed the appeal because the insured failed to pay the required CHF 800 advance on court costs within the extended, non-extendable deadline set by the Court, despite being warned that non-payment would render the appeal inadmissible. The decision is based on Articles 62(1) and (3) and 108(1)(a) and (2) of the Federal Supreme Court Act (LTF), which mandate that an appeal is inadmissible if the advance on costs is not paid in time. No court costs were imposed due to the circumstances of the case.

Oggetto
108 cpv. 1 lett. a e cpv.
