Unemployment insurance: appeal against RAV objection decision dismissed as inadmissible due to lack of legal injury after lower court annulled the objection in appellant's favor—Swiss federal procedural standing.
Legislator-Zusammenfassung
KI-generiertThe Swiss Federal Supreme Court (I. Social Law Division) dismissed the appellant's complaint in a decision dated November 12, 2010, declining to enter into the merits of the case. The appellant had challenged a decision by the Cantonal Insurance Court of St. Gallen, which had upheld his appeal and annulled an objection decision by the Regional Employment Center (RAV) regarding unemployment insurance benefits. The Supreme Court held that because the lower court had already ruled in the appellant's favor, he lacked the requisite legal interest or injury (Beschwer) under Art. 89 para. 1 lit. c BGG to appeal, and he could not raise issues before the federal court that were not part of the lower court's decision (Art. 82 BGG). Additionally, the complaint failed to meet the formal requirements of Art. 42 para. 1 and 2 BGG. The appeal was therefore dismissed as inadmissible under Art. 108 para. 1 lit. b BGG, no court costs were imposed, and the lower court's annulment of the RAV's decision remained in force.

vom 28. September 2010.

1. Auf die Beschwerde wird nicht eingetreten.
