Unemployment insurance appeal dismissed for failure to pay cost advance despite extended deadline; unclaimed registered notice deemed served under BGG Art. 44(2).
Legislator-Zusammenfassung
KI-generiertThe Swiss Federal Supreme Court (Bundesgericht) declined to enter the appeal and dismissed the case, ordering the appellant to pay court costs of CHF 200. The appellant, who is not identified by name, was the losing party in the underlying unemployment insurance dispute; that prior decision remains in force. The case concerns an appeal against a decision of the Social Insurance Court of the Canton of Zurich dated 25 March 2009 regarding unemployment insurance (Arbeitslosenversicherung), but the Court never reached the merits of the dispute. The Court dismissed the appeal because the appellant failed to pay the required CHF 500 cost advance despite being granted an extended deadline of 13 July 2009; the extension notice was sent via registered mail to the address provided by the appellant and, per Article 44(2) of the Federal Supreme Court Act (BGG), was deemed served when it was returned as unclaimed after the retrieval period expired. The proceedings were closed based on Article 62(3) BGG (failure to pay the advance within the grace period) in the simplified procedure under Article 108 BGG, and the Court did not address other apparent deficiencies such as inadequate grounds (Article 42 paragraphs 1 and 2 BGG) or timeliness (Article 100(1) BGG). The court fees were set at CHF 200, taking into account the circumstances of the case.

Urteil vom 31. Juli 2009
I. sozialrechtliche Abteilung
Besetzung
Bundesrichter Ursprung, Präsident,
Gerichtsschreiber Batz.
Parteien
I.________,
Beschwerdeführerin,
gegen
Arbeitslosenkasse des Kantons Zürich, Brunngasse 6, 8400 Winterthur,
Beschwerdegegnerin.
Gegenstand
Arbeitslosenversicherung (Prozessvoraussetzung),
In Erwägung,
