Disability insurance appeal; late filing beyond 30-day deadline under Art. 100 BGG and insufficient reasoning under Art. 42 BGG—inadmissible.
Legislator-Zusammenfassung
KI-generiertThe Swiss Federal Supreme Court (I. Social Law Division) refused to consider the complainant's appeal against the decision of the Social Insurance Court of the Canton of Zurich of 27 February 2018, because the appeal was filed out of time and also failed to meet the minimum substantiation requirements. The Court, in a unilateral order, declared the appeal inadmissible, waived court costs, and let the lower court's decision stand. The case concerned an appeal in the context of disability insurance (IV). The complainant had submitted the appeal on 11 May 2018 against a decision delivered on 22 March 2018, which was after the 30-day deadline (per Art. 100 para. 1 BGG) expired on 7 May 2018. Additionally, the appeal did not comply with the minimum reasoning requirements under Art. 42 para. 1 and 2 BGG. The Court based its decision on Art. 108 para. 1 lit. a BGG, applying the simplified procedure for clearly inadmissible appeals, and waived court costs under Art. 66 para. 1 sentence 2 BGG.
