Supplementary Benefits to Old-Age and Survivors Insurance: Appeal Dismissed for Insufficient Statement of Reasons Against Cantonal Insurance Court Ruling
Legislator-Zusammenfassung
KI-generiertThe Swiss Federal Supreme Court dismissed an appeal and a subsequent letter from the claimant, entering no decision on the merits, thereby leaving the lower court's ruling in force. The claimant had challenged a cantonal insurance court decision regarding supplementary benefits to the old-age and survivors' insurance. The Court held that the appeal failed to meet the formal requirements under Article 42 of the Federal Supreme Court Act, as it lacked a concise statement of how the lower decision violated the law. The Court also noted that the claimant's later filing did not cure the defect, as it was submitted after the statutory deadline for filing an appeal. Consequently, the appeal was inadmissible, and the claimant was ordered to pay court costs of 250 Swiss francs, with the remainder of the deposited advance refunded.

Urteil vom 3. August 2007
I. sozialrechtliche Abteilung
Besetzung
Bundesrichter Ursprung, Präsident,
Gerichtsschreiber Batz.
Parteien
K.________, Beschwerdeführer,
gegen
Sozialversicherungsanstalt des Kantons St. Gallen, Brauerstrasse 54, 9016 St. Gallen, Beschwerdegegnerin.
Gegenstand
Mai 2007.
Das Präsidium der I. sozialrechtlichen Abteilung hat nach Einsicht
in die Eingabe des K.________ vom 8. Juni 2007 (Poststempel) gegen einen Entscheid des Versicherungsgerichts des Kantons St. Gallen vom 8. Mai 2007 (EL 2007/6),
in Erwägung,
3. Dieses Urteil wird den Parteien, dem Versicherungsgericht des Kantons St. Gallen, der Sanitas Krankenversicherung, Zürich, und dem Bundesamt für Sozialversicherungen zugestellt.
