The Swiss Federal Supreme Court (First Social Law Division) declared the appellant's appeal inadmissible due to untimeliness, thus upholding the cantonal decision to deny the suspension of the suspensive effect of a prior appeal. The cantonal insurance court had rejected the request to reinstate the suspensive effect of an appeal against the insurer's decision that reduced the disability pension degree from 21% to 13% retroactively and removed the suspensive effect of any appeal. The procedural default was that the appeal was filed with the postal service on January 8, 2014, after the 30-day appeal period had expired on January 6, 2014, with no suspension of deadlines applying to suspensive effect matters as per Art. 46(2) LTF; consequently, the appeal was manifestly inadmissible under Art. 108(1)(a) LTF, and court costs of CHF 500 were imposed on the appellant.

Sentenza del 30 gennaio 2014

I Corte di diritto sociale

Composizione

Giudice federale Leuzinger, Presidente,

cancelliere Schäuble.

Partecipanti al procedimento

R.________,

ricorrente,

*contro*

*AXA Assicurazioni SA*, General Guisan-Strasse 40, 8401 Winterthur, patrocinata dall'avv. Riccardo Schuhmacher,

opponente.

Oggetto
