Appeal Dismissed for Failure to Pay Advance Costs
Legislator-Zusammenfassung
KI-generiertA party filed a complaint against a decision by the Appellationsgericht of Basel-Stadt concerning welfare and disqualification issues. The complaint was submitted with a request for free legal aid, which was denied due to the perceived hopelessness of the case. Subsequently, the party was ordered to pay a deposit for legal costs but failed to do so within the stipulated deadline. Consequently, the Swiss Federal Tribunal decided not to examine the complaint further, citing the lack of payment as the reason for dismissal. No court costs were imposed on the party.

KI-generiertUsed to rule on the non-admission of the appeal due to the failure to pay the cost advance.
Cited as the basis for the non-admission because the required cost advance was not paid.
Although not explicitly cited in the dispositive, the decision not to levy costs (Order 2) implies the application of cost rules; however, based strictly on the rule to only include explicitly cited articles in the dispositive, and seeing that the dispositive only contains 'Es werden keine Gerichtskosten erhoben', without citing Art. 66, I must rely only on the cited procedure articles (Art. 108 and Art. 62 al. 3). Given the explicit citation of Art. 62 Abs. 3 BGG and Art. 108 Abs. 1 lit. a BGG in the reasoning for non-admission due to non-payment, and no explicit cost article cited in the dispositive for levying or exemption, I must adhere strictly to the rule.
