Appeal Withdrawal Following Access Grant and Partial Cost Imposition The case involved an appeal against the refusal to grant access to a criminal file, which was subsequently withdrawn by the appellant. The Federal Court acknowledged the withdrawal of the appeal and removed the case from the register, noting that the reason for the withdrawal was the extraordinary prosecutor's decision to lift the file access restriction, which was the subject of the challenged proceedings. Given that the proceedings were essentially concluded at the time of withdrawal, including the issuance of a provisional measures order, the court considered the appellant the losing party under procedural law and partially imposed judicial costs of CHF 500 on the appellant, ordering the return of the remaining advance payment.

Ordonnance du 10 janvier 2025

IIe Cour de droit pénal

Composition

M. le Juge fédéral Abrecht, Président.

Greffière : Mme Kropf.

Participants à la procédure

A.________,

représenté par Me Yannis Sakkas et Me Sophie Haenni, avocats,

recourant,

*contre*
