Failure to Pay Advance on Costs Leads to Non-Entry into Appeal
Legislator-Zusammenfassung
KI-generiertFailure to Pay Advance on Costs Leads to Non-Entry into Appeal The situation involved an appellant who filed an appeal against a summons to an oral appellate hearing by the Cantonal Court. The Federal Court ordered the appellant to pay an advance on costs of CHF 800 by a set deadline, which was subsequently extended with a non-extendable grace period, and the appellant was warned that failure to pay would result in non-entry into the merits of the appeal, pursuant to Art. 62 para. 3 of the Federal Supreme Court Act (BGG). Since the appellant failed to pay the ordered advance on costs even within the non-extendable grace period, and no special reasons (such as poverty) for waiving the advance were apparent, the Federal Court decided not to enter into the appeal, applying Art. 62 para. 3 BGG in a simplified procedure under Art. 108 BGG, and imposed the court costs on the appellant.

Urteil vom 1. Oktober 2024
II. strafrechtliche Abteilung
Besetzung
Bundesrichterin Koch, als Einzelrichterin,
Gerichtsschreiber Hahn.
Verfahrensbeteiligte
A.________,
Beschwerdeführer,
*gegen*
Staatsanwaltschaft Basel-Landschaft, Hauptabteilung Allgemeine Delikte,
Grenzacherstrasse 8, Postfach, 4132 Muttenz.
Gegenstand
Vorladung Berufungsverhandlung; Nichteintreten,
Beschwerde gegen die Verfügung des Kantonsgerichts Basel-Landschaft, Abteilung Strafrecht, vom 8. August 2024 (460 24 146 ssc).
Erwägungen:
2. Gemäss
Art. 62 Abs. 1 Satz 1 BGG
Art. 62 Abs. 1 Satz 2 BGG
3. Dieses Urteil wird dem Beschwerdeführer, der Staatsanwaltschaft Basel-Landschaft, dem Kantonsgericht Basel-Landschaft, Abteilung Strafrecht, und Rechtsanwältin Stephanie Trüeb, Liestal, schriftlich mitgeteilt.
