Appeal against Inadmissibility Ruling on Community Service Execution Rejection Upheld The Swiss Federal Tribunal declared inadmissible a criminal appeal lodged against a cantonal court's decision, which had itself rejected as inadmissible an appeal against the refusal to allow for the execution of a 90-day prison sentence under community service (work of public interest). The cantonal decision was based on the appeal being untimely and insufficiently motivated, and also rejected a request for reinstatement of the deadline. The Federal Tribunal ruled the appeal inadmissible because the appellant failed to meet the required standards of legal reasoning under Article 42 para. 2 of the Federal Tribunal Law, by not adequately demonstrating how the prior court's findings—that the initial appeal was late and insufficiently reasoned—violated federal law. Consequently, the request for legal aid was also rejected due to the lack of prospects of success, and the judicial costs were imposed on the appellant, albeit reduced due to the financial situation.

Arrêt du 3 septembre 2024

IIe Cour de droit pénal

Composition

M. le Juge fédéral Abrecht, Président.

Greffier : M. Fragnière.

Participants à la procédure

A.________,

recourant,

*contre*

64 al. 1

*a contrario*
