Penal enforcement with electronic monitoring; appeal inadmissible for failure to pay cost advance despite final deadline under Art. 62 BGG.
Legislator-Zusammenfassung
KI-generiertThe Swiss Federal Supreme Court (II. criminal law division) did not enter into the merits of the appellant's criminal appeal and dismissed the case, ordering the appellant to pay court costs of CHF 500; the appellant therefore did not prevail, and the underlying cantonal administrative court decision (regarding penal enforcement with electronic monitoring) remains in force. The appellant had filed a criminal-law appeal against a decision of the Administrative Court of the Canton of Zurich dated 15 April 2024 concerning electronic monitoring in penal enforcement, but the appeal was dismissed without examination of the substance. The decisive legal basis was procedural: the appellant failed to pay the required court cost advance (CHF 800) despite multiple court-set deadlines and a final, non-extendable grace period (mandated under Art. 62 BGG), so the court applied Art. 62 para. 3 BGG and Art. 108 BGG to declare the appeal inadmissible and imposed costs under Art. 66 para. 1 BGG.

Gegenstand
Strafvollzug mit Electronic Monitoring; Nichteintreten,
Beschwerde gegen das Urteil des Verwaltungsgerichts des Kantons Zürich, 3. Abteilung, Einzelrichter,
vom 15. April 2024 (VB.2024.00169).
Erwägungen:
