Criminal appeal withdrawn for financial reasons: withdrawal of federal supreme court appeal in non-consideration case leading to case closure and cost imposition on appellant
Legislator-Zusammenfassung
KI-generiertThe Swiss Federal Supreme Court struck the case from the record and closed the proceedings, ordering the appellant to pay court costs of CHF 300. The appellant had filed a criminal-law appeal challenging a cantonal decision that declined to take up a case (non-consideration) and addressed the withdrawal of the complaint, but she withdrew her appeal for financial reasons. Because the withdrawal rendered the proceedings moot, the court dismissed the case under Article 32(2) of the Federal Supreme Court Act and allocated costs to the appellant as the party whose action caused the proceedings to lapse, per Article 66 of the same act.
