Legislator-Zusammenfassung

KI-generiert

In this case, an individual filed an appeal against a decision from a local authority concerning a debt collection process initiated for unpaid health insurance premiums. The individual's opposition to the collection was dismissed, leading to a notification of bankruptcy threats based on a creditor's request. The appellant claimed that the debt was incorrect and argued against the legitimacy of the collection proceedings. However, the supervisory authority rejected the complaint, stating that it was not within their remit to adjudicate the propriety of the debt claim and noted potential avenues for the appellant to contest the claim. The appeal to the Federal Tribunal was ultimately declared inadmissible, as the appellant failed to adequately demonstrate legal violations in the contested decision.

CHAMBRE DES POURSUITES ET DES FAILLITES

10 avril 2002

Composition de la Chambre: Mme Nordmann, présidente,

Mme Escher et M. Meyer, juges. Greffier: M. Fellay.

________

Statuant sur le recours formé

par

X.________,

contre

la décision rendue le 20 février 2002 par l'Autorité de surveillance des offices de poursuites et de faillites du canton de Genève;

(commination de faillite)

Considérant :

que le recourant a fait opposition à la poursuite no XX XXXXXX X de l'Office des poursuites Rive-Droite, intentée contre lui par la Y.________ en recouvrement de primes d'assurance-maladie;

que son opposition ayant été levée par une décision prise sur la base de l' art. 85 LAMal et demeurée inattaquée, il s'est vu notifier, sur réquisition de la poursuivante, une commination de faillite;

qu'il a alors déposé plainte en faisant valoir que le titre de créance était faux et que la procédure de recouvrement engagée contre lui procédait d'un "abus ... de confiance";

que l'autorité cantonale de surveillance a rejeté la plainte aux motifs qu'il n'appartient pas aux autorités de poursuite et de surveillance de décider si une prétention est exigée à bon droit ou non, qu'elle a même indiqué les voies à suivre par le débiteur si celui-ci conteste la dette, et qu'en l'espèce l'office était tenu de donner suite à la réquisition de continuer la poursuite en présence de la décision de mainlevée produite, qui énonçait clairement la poursuite en cause et mentionnait la possibilité pour le débiteur de former opposition;

que le recourant requiert le Tribunal fédéral de prononcer la nullité de la "demande de faillite", qui serait "illégale et fausse";

qu'il se contente toutefois d'exposer des faits et de contester des décomptes de la poursuivante, sans indiquer - comme l'exige l'art. 79 al. 1 de la loi fédérale d'organisation judiciaire (OJ) - en quoi la décision attaquée, telle qu'elle est motivée, violerait le droit fédéral;

que la Chambre de céans est au demeurant liée par les faits constatés dans la décision attaquée ( art. 63 al. 2 et 81 OJ ) et ne peut, comme l'autorité cantonale de surveillance, examiner si la prétention objet de la poursuite en cause est exigée à bon droit ou non ( ATF 115 III 18 consid. 3b p. 21, 113 III 2 consid. 2b p. 3);

Par ces motifs,

la Chambre des poursuites et des faillites:

1. Déclare le recours irrecevable.

2. Communique le présent arrêt en copie au recourant, à la Y.________, à l'Office des poursuites et faillites de Genève/Rive-Droite et à l'Autorité de surveillance des offices de poursuites et de faillites du canton de Genève.
