Debtor Company v. Cantonal Supervisory Authority (Late Appeal Regarding Bankruptcy Threat Notification)
Legislator-Zusammenfassung
KI-generiertIn this case, a company filed an appeal against a ruling from the supervisory authority over the debt collection and bankruptcy office, which had dismissed its complaint concerning a bankruptcy warning issued by the debt collection office. The appeal was submitted after the company had received the supervisory authority's decision, but it was deemed late, as the initial complaint had to be filed within a specific time frame. The court noted that the appeal also lacked sufficient grounds regarding violations of federal law, stating that even if it had been timely, it would still not have been considered due to inadequate justification.

KI-generiertThis provision (implied, based on standard practice for costs when an appeal is dismissed/not admitted by the Federal Tribunal, although not explicitly cited in the operative part, it is usually the basis for the underlying procedural decision that costs are imposed. *Self-correction*: Since the operative part only contains {1. Auf die Beschwerde wird nicht eingetreten.}, there are no explicit cost provisions cited in the operative part (unlike BGE 24 I 149 E. 1 S. 153 mentioned in the reasoning). I must strictly follow the rule: Include only provisions explicitly cited in the dispositive. Since only order 1 exists and cites no provisions, and order 2 is a notification order, the resulting array must be empty or adjusted based on what is strictly in the numbered orders. As no article is listed in orders 1 or 2, I exclude them.
Cited in the reasoning regarding the scope of appeal, supporting the decision not to enter on the merits.
Cited in the reasoning to establish the starting point of the appeal deadline, which led to the finding of untimeliness in the dispositive.
Cited in the reasoning concerning the date of filing the appeal with the post office, directly leading to the finding of untimeliness.
Cited in the reasoning regarding the scope of appeal, supporting the decision not to enter on the merits.

Urteil vom 30. September 2002
Schuldbetreibungs- und Konkurskammer
Bundesrichterin Nordmann, Präsidentin,
Bundesrichterin Escher, Bundesrichter Meyer,
Gerichtsschreiber Levante.
X.________ GmbH,
Beschwerdeführerin,
gegen
Aufsichtsbehörde über das Betreibungs- und Konkursamt des Kantons Basel-Stadt, Bäumleingasse 5, Postfach 964, 4001 Basel.
Konkursandrohung,
in Erwägung,
