Legislator-Zusammenfassung

KI-generiert

The case involves a complaint submitted against a decision made by the higher regional court regarding the estimation and auctioning of properties in a bankruptcy proceeding. The complainant appealed a ruling from the district court, which found that there was no grounds for a reassessment of the property values in the context of the bankruptcy process. The higher regional court upheld the district court's ruling, asserting that only the official appraisals, rather than private assessments commissioned by the complainant, should be considered. The complainant's arguments were deemed insufficient, and new evidence presented was not acceptable under the procedural rules. Consequently, the appeal was not accepted, with indications that further appeals might result in penalties.

Art. 93 LTF
Although the text cites Art. 79 Abs. 1 OG and mentions the lack of a federal law violation, the final order is 'Auf die Beschwerde wird nicht eingetreten' (No entry upon the appeal). Since the text does not explicitly cite Art. 93 LTF (or its predecessor Art. 93 OG) in the dispositive, and the reasoning refers to the lack of a federal law violation, the primary procedural basis for non-entry is implied by the context of the review scope (Art. 9 Abs. 2 VZG mentioned in reasoning), but only explicitly cited procedural/substantive rules in the dispositive count. Since the dispositive only contains the non-entry order (1.) and notification orders (2.), and no specific procedural article is cited in the dispositive, we rely only on explicitly cited articles in the dispositive. As no article is explicitly cited in the dispositive (1. and 2.), the output must be empty based on the strict rule, unless cost/legal aid articles are present.

Urteil vom 4. Oktober 2006

Schuldbetreibungs- und Konkurskammer

Besetzung

Bundesrichterin Hohl, Präsidentin,

Bundesrichter Meyer, Marazzi,

Gerichtsschreiber Schett.

Parteien

X.________,

Beschwerdeführer,

gegen

Obergericht des Kantons Zürich, II. Zivilkammer,

in Erwägung,
