Appeal Dismissed for Untimely Filing and Lack of Motivation
Legislator-Zusammenfassung
KI-generiertThe case involves an appeal filed against a decision made by the Court of Enforcement and Bankruptcy of the Canton of Vaud, which served as the supervisory authority in a debt collection process. The appellant contested the realization of a pledge and the associated accounting but failed to submit the appeal within the stipulated ten-day period following the notification of the lower court's decision, rendering the appeal late and inadmissible. Furthermore, the appeal did not meet the necessary motivation requirements as outlined in the applicable legal provisions.

KI-generiertThe appeal was declared inadmissible (although the text cites the former OJ provisions for admissibility/timing, the final order implicitly relies on the current procedural framework, but since the dispositive only states 'irrecevable' without citing a specific LTF article for the inadmissibility itself, and the reasoning cites Art. 19 al. 1 LP and Art. 79 al. 1 OJ, we must check if any LTF article is cited in the dispositive. Since no LTF article is explicitly cited in the dispositive (only '1. Le recours est irrecevable.'), and the reasoning cites old law (OJ), we must strictly adhere to the rule: only provisions explicitly cited in the dispositive are included. As no provision is cited in order 1, we check for costs/procedural rules in the dispositive. None are cited in order 2 either, except for communication.)

Arrêt du 16 août 2006
Chambre des poursuites et des faillites
Composition
Mme et MM. les Juges Hohl, Présidente,

Greffier: M. Fellay.
Parties
X.________,
recourante,
contre
que selon l' art. 19 al. 1 LP , le délai de recours au Tribunal fédéral est de dix jours dès la notification de la décision de l'autorité cantonale de surveillance;
qu'en l'espèce, cette décision ayant été notifiée à la recourante le 21 juillet 2006, le délai de recours est arrivé à échéance le 31 juillet 2006, conformément aux dispositions de l'art. 32 de la loi fédérale d'organisation judiciaire (OJ);
que remis à la poste le 2 août 2006 seulement, le présent recours est donc tardif, partant irrecevable;
qu'il ne contient au demeurant aucune motivation répondant aux exigences de l' art. 79 al. 1 OJ ;
Par ces motifs, la Chambre prononce:
1. Le recours est irrecevable.
